Terms of Use & End User License Agreement (EULA)

Last Updated: Wednesday, March 25, 2026 Please read these Terms and Conditions (“Terms”) carefully before using the Beacon Home App (the “App”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms Your use of the App constitutes your acceptance of these Terms and our Privacy Policy. These Terms form a legally binding agreement between you and BeaconHome App, Inc.

2. License to Use We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms and applicable laws.

3. Emergency Functionality Disclaimer The Beacon Home App includes features designed to assist in emergency situations, such as automated dialing of emergency services, geolocation reporting, and activation of connected smart devices (e.g., porch lightbulbs). These features may operate via Bluetooth or WiFi, depending on your device configuration.

Bluetooth connectivity is supported for basic functionality and short-range device activation.

For extended range and enhanced reliability—particularly on Apple iOS devices—WiFi connectivity is required. This may necessitate the purchase of a compatible Philips WiFi bridge, which enables the App to communicate with supported smart devices over your home network.

You acknowledge and agree that:

· We do not guarantee successful contact with emergency services, accurate location transmission, or activation of connected devices.

· Functionality may be impaired by factors outside our control, including but not limited to device compatibility, network availability, hardware failure, user error, or third-party service interruptions.

· You remain solely responsible for ensuring your safety and contacting emergency services through alternative means if necessary.

· The App is not a substitute for professional emergency response systems or medical alert devices.

4. User Accounts

· You may need to create an account to access certain features.

· You are responsible for maintaining the confidentiality of your credentials and all activity under your account.

· You must provide accurate and complete information.

· You must be at least 13 years old (or the minimum age in your jurisdiction).

5. Prohibited Uses

You agree not to:

· Use the App for unlawful purposes

· Interfere with or disrupt the App or its systems

· Transmit harmful code or content

· Harass or impersonate others

· Collect data from other users without consent

6. Intellectual Property

All content and functionality of the App—including text, graphics, software, and trademarks—are owned by BeaconHome App, Inc. and protected by intellectual property laws.

7. User-Generated Content

· You retain ownership of content you submit.

· You grant us a non-exclusive, royalty-free license to use it in connection with the App.

· You represent that you have the rights to submit such content.

· We may remove content that violates these Terms.

8. Privacy

Your use of the App is governed by our Privacy Policy, which explains how we collect, use, and protect your data.

9. In-App Purchases

· Purchases are final and non-refundable unless required by law.

· Prices may change without notice.

· Payment is processed through your Apple ID or other platform account.

10. Third-Party Services

We are not responsible for the content, policies, or reliability of third-party services or devices connected to the App.

11. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

· The App will function without interruption or error

· Emergency features will operate as intended

· Any errors will be corrected

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEACONHOME APP, INC. SHALL NOT BE LIABLE FOR:

· INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES

· LOSS OF DATA, PROFITS, OR GOODWILL

· FAILURE OF EMERGENCY FEATURES OR CONNECTED DEVICES

· ANY CLAIM ARISING FROM YOUR RELIANCE ON THE APP IN AN EMERGENCY

13. Indemnification

You agree to indemnify and hold harmless BeaconHome App, Inc. from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

14. Termination

We may suspend or terminate your access to the App at any time, without notice, for conduct that violates these Terms or is harmful to others.

15. Changes to Terms

We may update these Terms at any time. Continued use of the App after changes constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles.

17. Apple-Specific Terms

· These Terms are between you and BeaconHome App, Inc., not Apple.

· Apple is not responsible for support, liability, or intellectual property claims related to the App.

· Apple and its subsidiaries are third-party beneficiaries of these Terms.

19. Severability

If any provision is found unenforceable, the remainder of the Terms will remain in full force and effect.

20. Subscription Details

The Beacon Home App offers the following auto-renewable subscription:

· Subscription Name: BeaconHome Monthly Plan

· Subscription Length: 30 days (monthly)

· Price: $3.99 per month (USD)

· Free Trial: A 1-month free trial is included for new subscribers. The free trial automatically converts to a paid subscription at $3.99/month unless canceled at least 24 hours before the end of the trial period.

· Billing & Renewal: Payment will be charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews at the end of each billing period unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

· Cancellation: You can manage and cancel your subscription at any time by going to your Apple ID Account Settings after purchase. Cancellation takes effect at the end of the current billing period.

End User License Agreement (EULA)

This End User License Agreement (“Agreement”) governs your use of the Beacon Home App (the “App”). By downloading or using the App, you agree to this Agreement.

This Agreement reiterates and supplements the Terms of Use above and does not replace them. In the event of any conflict, the stricter provision shall apply.

All emergency service disclaimers, limitations of liability, Apple-specific terms, and governing law provisions stated above apply fully to this Agreement as if restated in full.
